Community Cat Trap Loan Program — Terms, Conditions, and Liability Release

This document sets the terms under which Aloha Animal Alliance ("AAA," "we," or "us") loans humane cat traps and related equipment (the "Equipment") to a borrower ("Borrower," "you") for community cat work in Hawaiʻi. Please read the entire document before signing. If you do not understand any part of this agreement, ask an AAA representative before you borrow Equipment.

1. Permitted Use of Equipment
Equipment loaned through this program may be used ONLY for the following purposes:

• Trap-Neuter-Return (TNR): humanely trapping community (free-roaming, unowned) cats for the purpose of spay/neuter, vaccination, eartipping, and return to their outdoor location, consistent with best practices; or

• Locating and safely capturing a specific lost or missing owned pet

• Equipment may NOT be used for any other purpose, including but not limited to unauthorized relocation or removal of cats or lost-pet basis, trapping for transfer to euthanasia healthy cats, trapping of wildlife other than as incidental to the above, or trapping on private property without permission. Any use outside these permitted purposes is a material breach of this agreement and may result in immediate forfeiture of your deposit, denial of future equipment loans, and referral to appropriate authorities.

2. Trapping Best Practices
Borrower agrees to follow humane trapping best practices, including the following minimum requirements:

1. Notify neighbors in advance. Before trapping begins, inform neighbors and anyone feeding cats in the area that TNR trapping will occur, when, and why. Reassure them that cats will be returned to the location after surgery and recovery unless a documented exception applies.

2. Post visible signage. Place clearly visible signs at the trapping site (and, where practical, at entry points to the area) noting that humane trapping is in progress, a contact name/number, and that any pet cats should be kept indoors during the trapping period.

3. Never leave traps unattended. Set traps only when you can remain within sight and sound of the trap at all times. Check traps at least every 30 minutes. A trapped cat must never be left alone for an extended period, exposed to weather, or left overnight without direct supervision.

4. Cover traps immediately after capture with a large towel or sheet to reduce the cat's stress, and move the covered trap to a safe, temperature-appropriate location promptly.

5. Withhold food (not water, where appropriate) from target cats for a reasonable period before trapping per your TNR coordinator's instructions, and bait humanely.

6. Protect trapped cats from extreme heat, cold, rain, and direct sun at all times, including during transport. Transporting trapped cats in an uncovered truck bed is not a humane method of transport.

7. Transport trapped cats directly and promptly to the scheduled spay/neuter appointment or, for lost-pet recoveries, to the coordinating point of contact or owner.

8. Do not reach into a trap or attempt to handle an unknown cat directly. Contact your AAA coordinator immediately if a cat is injured, a non-target animal is caught, or any unsafe situation arises.

9. Follow all applicable county and state animal control ordinances and any site-specific instructions provided by AAA or the property owner/manager where trapping occurs.
AAA may provide additional written or verbal instructions specific to your trapping location or situation; those instructions are incorporated into this agreement by reference.
3. Equipment Condition, Care, and Return

• Borrower will inspect Equipment at pickup and note any pre-existing damage on the equipment log.

• Borrower is responsible for keeping Equipment clean, dry (as possible, given Hawaii climate), and in good working condition while in Borrower's possession.

• Equipment must be returned by the agreed return date in the same condition as received, ordinary wear excepted.

• Lost, stolen, or damaged Equipment (beyond ordinary wear) is Borrower's financial responsibility. Borrower agrees to forfeit their deposit if traps are not returned in working condition.

• Equipment remains the property of Aloha Animal Alliance at all times and is loaned, not transferred, to Borrower.

4. Assumption of Risk and Release of Liability
Trapping community cats and handling equipment involves inherent risks, including but not limited to bites, scratches, zoonotic disease exposure (such as rabies), physical strain, property access issues, interactions with wildlife or other animals, and vehicle or transport-related risks. By signing below, Borrower voluntarily assumes all such risks.
Borrower, on behalf of themselves and their heirs, executors, and assigns, releases, waives, and discharges Aloha Animal Alliance, its officers, directors, employees, and volunteers from any and all liability, claims, demands, or causes of action arising out of or related to Borrower's use of the Equipment or participation in trapping activities under this program, EXCEPT to the extent such claims arise from AAA's gross negligence or willful misconduct.

Borrower agrees to indemnify and hold harmless Aloha Animal Alliance from any claims, damages, or expenses (including reasonable attorney's fees) arising from Borrower's use of the Equipment, Borrower's violation of this agreement, or Borrower's negligent or unlawful acts or omissions in connection with trapping activities.
Borrower confirms they are physically able to safely handle the Equipment and, where required, will supervise any minors or other volunteers assisting them, who remain Borrower's responsibility at all times.

5. Deposit and Fees

Deposits are refunded upon timely return of Equipment in good condition, less any amounts owed under Section 3. AAA may waive or adjust deposit amounts at its discretion for approved volunteers and program partners.

6. Term, Renewal, and Program Discretion
The trap loan will begin at the time of trap pickup and extend for one week unless otherwise negotiated. Extensions must be requested from AAA before the return date. AAA reserves the right to recall Equipment early, deny or revoke future loans, and modify this program's terms at any time, including for repeated late returns or any violation of Sections 1 or 2.

7. Acknowledgment and Signature
By submitting this form, Borrower acknowledges that they have read, understood, and agree to be bound by all terms of this Community Cat Trap Loan Program agreement, including the Permitted Use restrictions (Section 1), Trapping Best Practices (Section 2), and the Assumption of Risk and Release of Liability (Section 4).
